Fitzsimmons Automation Terms of Service

1. The service

Fitzsimmons Automation (Australia) provides an SMS assistant for trade and service businesses. It answers missed calls by SMS, qualifies enquiries, follows up quotes, books jobs, requests reviews, and provides a web portal - on a phone number provisioned for your business.

2. Accounts and setup

The service is set up personally for each business by Fitzsimmons Automation under a direct agreement. You must provide accurate business details and have the right to use the phone number and calendar you connect.

4. Google Calendar connection

Connecting a Google Calendar is optional and governed by our Privacy Policy. You may disconnect at any time; if bookings are enabled and no calendar is reachable, the assistant stops offering booking times rather than risk double-booking you.

5. Fees

Setup and monthly fees are as agreed in writing with each business. Telephony usage (numbers, SMS) is passed through at cost unless agreed otherwise.

6. Service levels and liability

The service depends on third-party networks (telephony, hosting, AI). We work to keep it reliable - including automatic fallbacks when components fail - but the service is provided without warranty of uninterrupted operation. To the maximum extent permitted by law (including the Australian Consumer Law, whose guarantees are not excluded), Fitzsimmons Automation's total liability for any claim relating to the service is limited to the fees paid by the business in the three months before the claim arose, and neither party is liable for indirect or consequential loss.

7. Termination

Either party may end the service with notice as per the business's agreement. On termination the business's number is released after a deactivation warning, automation stops, and data is handled as described in the Privacy Policy.
